What if my insurance company gives me a check written to me and the auto body co, but is more than itcosts?
Posted by admin on February 10, 2010I had damage to my vehicle for which I filed insurance and the insurance company gave me a check for 3300 less the 500 dollar deductible(originally 3800). The check is written out to Me and the body shop. The auto body shop said they would charge me 3000. What can I do? Am I allowed to cash in the whole amount then pay the body shop, or do I give the whole check to them?
I’m not sure but this sounds a little like insurance fraud so be careful. You both must endorse the check. If it were me and I did this, I would get that $300. (cash) from the body shop, in my hand BEFORE endorsing the check though.

It was meant for you to sign it then hand it over to the body shop to cash, for the amount of the work done. If you and the body shop decided to go another way and it comes out cheaper then you can work it out with them on the amount left over. But if was done so that it shows that the body shop charges one price that way you will come out with extra and the insurance follows up, it will be considered insurance fraud, which is obviously a crime. Its really a ethics situation, you know you should give the money back but its so tempting..lol
